This is an "attractive nuisance" death action by Cornelia Courtright to recover damages for the alleged negligent killing by defendant of plaintiffs six year old son when he fell from and was run over by one of defendants trailers on the streets of Galveston. The defendant, Southern Compress & Warehouse Company, filed a motion for summary judgment on the pleadings under Rule 166-A, Texas Rules of Civil Procedure. On hearing, after notice, and under that Rule, the trial court entered summary judgment against plaintiff, from which she appeals.
